Claimant was a resident shot on the premises in the apartment complex where he lived. Two other residents were involved in an intoxicated dispute. One hit the other in the head with a bottle in a parking lot confrontation.
The resident then retrieved a firearm from his vehicle and went to the apartment where he mistakenly believed the attacker lived. He fired shots at the door, hitting Claimant in the abdomen. Claimant’s family, including minor children, witnessed the shooting. A lawsuit was filed and ultimately settled.
